Benefit termination supported by record, ime, judge rules
BALTIMORE - A disability administrator’s decision to terminate benefits to a claimant with chronic back pain was supported by the evidence, a federal judge ruled Nov. 5, finding that the insurer’s reliance on the medical records and an independent medical exam was not an abuse of discretion (Keith Bowling v. PBG Long-Term Disability Plan and VPA Inc., No. JFM-07-02984, D. Md.; 2008 U.S. Dist. LEXIS 91111). Full story on lexis.com (Source: LexisNexis® Mealey’s™ Disability Insurance Legal News)
